By accessing and using spicytales.ai, You confirm that You are in agreement with and bound by the terms of service contained in the Terms & Conditions outlined below. These terms apply to the entire Service and any email, Telegram, or other type of communication between You and spicytales.ai.

Under no circumstances shall the spicytales.ai team be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site or Service, even if spicytales.ai or an authorized representative has been advised of the possibility of such damages. spicytales.ai is not responsible for any content, code or any other imprecision. If Your use of materials from this site or Service results in the need for servicing, repair or correction of equipment or data, You assume any costs thereof.

spicytales.ai grants You a revocable, non-exclusive, non-transferable, limited license to use the Service strictly in accordance with the terms of this Agreement and the Content guidelines (the “License”).

These Terms & Conditions are a contract between You and spicytales.ai (referred to in these Terms & Conditions as "spicytales.ai", "us", "we" or "our"), the provider of the spicytales.ai Website and Telegram bot (which are collectively referred to in these Terms & Conditions as the "Service").

To help explain things as clearly as possible in these Terms & Conditions, every time any of these terms are referenced, they are strictly defined as:

• Bot / Telegram bot: the spicytales.ai experience available through Telegram at @spicytalesai_bot, allowing You to access the License and use the Service.
• Chat: an interactive exchange of messages between You and a companion or storyline on the Service, where You input messages and the Service generates responses.
• Companion(s) / Character(s): AI roleplay personas powered by spicytales.ai technologies using varied AI models, including but not limited to large language models. Chats, avatars, and conversations are fictional and should not be taken as real-life situations or advice.
• Cookie: small amount of data generated by a website and saved by Your web browser. It is used to identify Your browser, provide analytics, or remember information about You such as language preference.
• Content guidelines: the rules for creating, interacting with, and using the License in regards to companions and storylines.
• Company: when these terms mention “Company,” “we,” “us,” or “our,” it refers to spicytales.ai, responsible for Your information under these Terms & Conditions.
• Device: any internet-connected device such as a phone, tablet, computer, or other device that can be used to visit spicytales.ai and use the Service.
• Generations: individual outputs or responses the Service produces based on input it receives from You, such as text, image, voice, or another form of output.
• Service: the service provided by spicytales.ai through a License for personal use of the Website and/or Telegram bot.
• Third-party service: advertisers, payment processors, Telegram, promotional partners, and others who provide content or whose products or services we think may interest You.
• Website: spicytales.ai’s website allowing You to learn about and access the Service.
• You / Your: a person or entity that is visiting spicytales.ai or using the Services via Telegram or otherwise.

The Service is strictly intended for adults. By using the Service, You represent and warrant that You are at least eighteen (18) years of age, or the age of majority in Your jurisdiction, whichever is greater. You may not use the Service if You are under 18. All companions and fictional characters on the Service are depicted as adults 18 years of age or older.

You agree not to, and You will not permit others to:

• Provide a license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Service or make the platform available to any third party.
• Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the Service and its associated technologies.
• Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of spicytales.ai or its affiliates, partners, suppliers or the licensors of the Service.
• Use automated methods to scrape, harvest, or gather data from the Service without prior written permission.
• Attempt to bypass any block, rate limit, or access restriction applied to Your account or Device.

spicytales.ai may use third-party solutions, including Telegram Stars or other payment providers, to process payments for subscriptions or premium access. We work with known providers who offer security infrastructure to protect financial information and take reasonable steps to prioritize the security of Your personal and payment information.

If You register for any recurring payment plan, You agree to pay all fees or charges to Your account for the Service in accordance with the fees, charges and billing terms in effect at the time that each fee or charge is due and payable. Your Payment Provider agreement governs Your use of the designated payment method, and You must refer to that agreement and not these Terms to determine Your rights and liabilities with respect to Your Payment Provider.

spicytales.ai reserves the right at any time to change its prices and billing methods, either immediately upon posting on our Website or Bot or by notice to You through the Service. You are responsible for any third-party fees that You may incur when using the Service.

Value-added tax (VAT), sales tax or other excise tax may be included in, or added to, the price for Service made available to You depending on Your country, state, territory, city, or other applicable local regulations. Tax rates may vary accordingly.

In the event the Service becomes taxable in Your jurisdiction during an ongoing subscription, You agree spicytales.ai is allowed to change the total amount of the payment that You owe so that it covers the original amount of Your chosen subscription, plus the appropriate taxes as required by tax authorities.

We take the privacy and security of Your personal information and chats seriously. Our commitment to protecting Your data is reflected in our internal policies and procedures.

Employee and contractor access. Our employees and contractors adhere to internal policy prohibiting unauthorized access to users' personal information and chats, and are required to commit to data protection measures.

Continuous improvement. We continuously enhance data protection strategies, including encryption and anonymization where appropriate, and regularly review security protocols.

Data retention. spicytales.ai retains personal information and chats for as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Once personal data is no longer needed for these purposes, we securely delete or anonymize it. spicytales.ai reserves the right to change its data retention policy at any time, including the right to delete Generations and Chat content without notice.

Users may request deletion of their personal data and chat history, subject to any legal obligations that may require us to retain certain information for a specified period. Further detail is set out in our Privacy policy.

By placing an order or making a purchase through spicytales.ai or its Payment Providers, You agree to these Terms along with this Refund policy.

If, for any reason, You are not completely satisfied with any good or service that we provide, contact us and we will discuss any issues You are experiencing with our product. Refund eligibility may depend on the Payment Provider’s rules (including Telegram Stars) and applicable law.

Any feedback, comments, ideas, improvements or suggestions (collectively, "Suggestions") provided by You to spicytales.ai with respect to the Service shall remain the sole and exclusive property of spicytales.ai.

By using the Service, You consent to receive electronic communications from spicytales.ai relating to Your use of the Service. Communications may involve Telegram messages, in-bot notices, or emails if You have provided an email address. Communications may include notices about Your account, payments, and other transactional information.

You acknowledge that any notices, agreements, disclosures, or other communications that spicytales.ai sends You electronically will satisfy any legal communication requirements, including that these communications be in writing. You also acknowledge that communications You receive from spicytales.ai may contain sexually explicit material unsuitable for minors.

You acknowledge and agree that spicytales.ai may stop (permanently or temporarily) providing the Service (or any features within the Service) to You or to users generally at spicytales.ai’s sole discretion, with or without prior notice to You. You may stop using the Service at any time.

spicytales.ai reserves the right to modify, suspend or discontinue, temporarily or permanently, the Service or any service to which it connects, with or without notice and without liability to You.

spicytales.ai may from time to time provide enhancements or improvements to the features and functionality of the Service, which may include patches, bug fixes, updates, upgrades and other modifications ("Updates"). Updates may modify or delete certain features and/or functionalities. You agree that spicytales.ai has no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features and/or functionalities of the Service to You. All Updates will be deemed an integral part of the Service and subject to this Agreement.

We may display, include or make available third-party content or provide links to third-party websites or services ("Third-party services"), including Telegram and payment processors.

You acknowledge and agree that spicytales.ai shall not be responsible for any Third-party services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. spicytales.ai does not assume and shall not have any liability or responsibility to You or any other person or entity for any Third-party services. You access and use them entirely at Your own risk and subject to such third parties' terms and conditions.

In the event that You submit or post any ideas, creative suggestions, designs, photographs, information, data or proposals, including ideas for new or improved products, services, features, technologies or promotions, You expressly agree that such submissions will automatically be treated as non-confidential and non-proprietary and spicytales.ai will be allowed to use them as per these Terms and Conditions without any compensation or credit to You whatsoever.

This Agreement shall remain in effect until terminated by You or spicytales.ai.

spicytales.ai may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice. This Agreement will terminate immediately, without prior notice from spicytales.ai, in the event that You fail to comply with any provision of this Agreement. You may also terminate this Agreement by stopping use of the Service and requesting deletion of Your data where available.

Upon termination of this Agreement, You shall cease all use of the Service. Termination will not limit any of spicytales.ai's rights or remedies at law or in equity in case of breach by You of any of Your obligations under this Agreement.

If You are a copyright owner or such owner’s agent and believe any material on our Service constitutes an infringement on Your copyright, please contact us setting forth the following information: (a) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (b) identification of the material that is claimed to be infringing; (c) Your contact information, including Your address, telephone number, and an email; (d) a statement by You that You have a good faith belief that use of the material is not authorized by the copyright owners; and (e) a statement that the information in the notification is accurate, and, under penalty of perjury, You are authorized to act on behalf of the owner.

You agree to indemnify and hold spicytales.ai and its parents, subsidiaries, affiliates, officers, employees, agents, partners and licensors (if any) harmless from any claim or demand, including reasonable attorneys' fees, due to or arising out of Your: (a) use of the Service; (b) violation of this Agreement or any law or regulation; or (c) violation of any right of a third party.

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, spicytales.ai, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.

Without limitation to the foregoing, spicytales.ai provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, websites, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Some jurisdictions do not allow the exclusion of or limitations on implied warranties or the limitations on the applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You.

Unless caused by gross negligence or intentional misconduct, spicytales.ai, its directors, officers, employees, agents, subsidiaries, affiliates, licensors, content providers, and service providers will not be liable to You for any direct, indirect, special (including so-called consequential damages), statutory, punitive, or exemplary damages arising out of or relating to Your access or Your inability to access the Service or its content. This exclusion applies regardless of the theory of liability and even if You told spicytales.ai or it knew or should have known about the possibility of damages.

If You are dissatisfied with the Services or have any other complaint, Your exclusive remedy is to stop using the Services. spicytales.ai's maximum liability to You for any claim will not exceed the greater of $200 and the amount You have paid to spicytales.ai for the applicable purchase out of which liability arose, even if that remedy fails of its essential purpose.

The disclaimers, exclusions, and limitations stated in these Terms apply to the greatest extent allowed by law, but no more. spicytales.ai does not intend to deprive You of any mandatory protections provided to You by law.

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Agreement shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute waiver of any subsequent breach.

spicytales.ai reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, You are no longer authorized to use spicytales.ai.

When You submit content to spicytales.ai, You are confirming that You either own the content (including all copyrights and rights of publicity) or have obtained all necessary permissions to submit it.

You retain ownership of Your content, but by submitting it, You give spicytales.ai permission to use it in various ways, such as copying, displaying, distributing, and modifying it, across any medium or technology now known or developed in the future, as needed to operate, improve, and promote the Service. This permission is nonexclusive, worldwide, royalty-free, fully paid up, transferable, sublicensable, perpetual, and irrevocable to the extent necessary for those purposes.

When You create or customize a companion or storyline using our services, You may own that custom configuration and content You uniquely contribute. You also own content generated by Your own interactions with that companion for Your personal use, subject to the License below.

By using our services, You grant spicytales.ai the right to use Your companions, Generations, and Chats as needed to operate, improve, moderate, and promote the Service. When You interact with a companion created by spicytales.ai or another user, the companion itself and other platform content remain the property of spicytales.ai or the original creator.

AI-generated chats can be unpredictable. You should evaluate and bear the risks of using any content. If You rely on this content, You do so at Your own risk. We have the right to refuse or remove any content at our discretion, especially if it violates our terms or is deemed objectionable.

The Service and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by spicytales.ai, its licensors or other providers of such material and are protected by applicable copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. The material may not be copied, modified, reproduced, downloaded or distributed in any way, in whole or in part, without the express prior written permission of spicytales.ai, unless and except as is expressly provided in these Terms & Conditions.

While we do not disclose content, data and chats without an official request from the authorities where required, spicytales.ai may preserve and disclose content and metadata to comply with laws, enforce our terms, respond to claims, or protect the rights and safety of spicytales.ai, our users, and the public.

You may not create, generate, upload, request, share, or otherwise make available through the Service any content that is illegal or that violates our Content guidelines. Prohibited content includes, but is not limited to:

• content that depicts, sexualizes, or otherwise involves minors, including AI-generated or fictional depictions of minors;
• real photographs or AI-generated portraits that depict or resemble actual individuals, regardless of whether those individuals are public or private, including composites, morphs, or deepfakes;
• content that depicts or sexualizes a real, identifiable person in sexual or intimate content, including AI-generated, edited, or deepfake depictions;
• non-consensual sexual activity, or sexual activity involving any person who is unable to give consent;
• content depicting incest or suggesting incestuous relationships;
• bestiality or acts involving animals in a sexual context;
• sexual violence, including rape or the depiction of sexual assault;
• sexual content depicting persons who are intoxicated, drugged, or otherwise incapacitated;
• hate speech, discrimination or hostility towards any race, religion, gender, nationality, or sexual orientation.

This list is not exhaustive. spicytales.ai may remove any content that violates this policy or that it otherwise considers objectionable, and may suspend or terminate the account of any user responsible. Further detail is set out in our Content guidelines.

All abuse notices, including alleged child sexual abuse material (CSAM), should be directed to us via the contact methods below.

spicytales.ai maintains a zero-tolerance policy toward human trafficking, sex trafficking, and the commercial sexual exploitation of any person. spicytales.ai does not permit the Service to be used in any manner that is associated with, assists, or facilitates human trafficking, sex trafficking, prostitution, or any related exploitation. All persons depicted in content on the Service must be adults, and all such content must be consensual. Any content found to violate this policy will be removed, and spicytales.ai may suspend or terminate the account of any responsible user without notice. Suspected violations may be reported to law enforcement and the appropriate authorities.

Where spicytales.ai becomes aware of apparent child sexual abuse material (CSAM) — including AI-generated or computer-generated depictions of minors — or other apparent child sexual exploitation, it reports such material to the appropriate authorities and child protection organizations as required by applicable law. Suspected violations regarding human trafficking, sex trafficking, and the commercial sexual exploitation of any person may also be reported to appropriate authorities.

spicytales.ai otherwise cooperates with law enforcement and responds to valid legal process, and may report conduct that poses an imminent threat to the safety of any person.

You may report content or conduct that may be illegal or otherwise violate this agreement through the Service or via the contact methods below. You state that You will not make any complaint or request that is wholly unjustified, abusive, or made in bad faith. If spicytales.ai determines that You have breached this warranty, spicytales.ai may suspend or terminate Your account.

Except where prohibited by mandatory local law, these Terms & Conditions and any dispute arising out of or relating to them or the Service shall be governed by applicable law as designated by spicytales.ai, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods will not govern this agreement.

Force majeure. spicytales.ai is not responsible for any failure to perform if unforeseen circumstances or causes beyond its reasonable control delay or continue to delay its performance, including acts of God, war, terrorism, strikes, infrastructure failure, hacking, or similar events.

No third-party beneficiaries. Except for indemnified parties, who are third-party beneficiaries of this agreement, this agreement does not confer any rights or remedies on any person other than the parties to this agreement.

Relationship of the parties. This agreement does not create a partnership, joint venture, agency, franchise, or employment relationship between the parties.

Electronic signatures. Any affirmation, assent, or agreement You send through the Service will bind You. When You click on an "I agree," "I consent," or other similarly worded button or continue using the Service after notice of these Terms, Your agreement or consent will be legally binding and enforceable and the legal equivalent of Your handwritten signature.

Electronic communications not private. You should not use the Service to send or receive messages that You only intend the sender and named recipients to read beyond ordinary chat privacy expectations of the platforms You use (including Telegram).

This Agreement constitutes the entire agreement between You and spicytales.ai regarding Your use of the Service and supersedes all prior and contemporaneous written or oral agreements between You and spicytales.ai.
